Commercial claims are often contract disputes, collection of accounts and employer/employee issues. Contract disputes usually are the result of poor communication between the parties. An examination of the interpretation of the factual differences between the parties will often show the parties are not that far apart on resolving the issues between them. When the dispute rests on proof of factual issues each party should be reminded a judge or jury can leave either party out in the cold. The decision tree method is applicable helping the parties reach an acceptable agreement that benefits both parties.
