Probate and Guardianship Mediation

The underlying driving force behind many probate cases and guardianship cases is often lack of personal communication among family members, past resentments among family members and failure to share information. An experienced mediator can restore communication, help family members deal with past resentments and hurts and focus on the main issues involved in the probate of estates; the identity and value of property, the fair and equitable division of property. Guardianship conflicts often arise when a parent resists the appointment of a guardian, when children cannot agree who should be the guardian of the person, and who should be guardian of the finances, if, when and where should the parent be placed in a retirement home, or nursing home. It is difficult enough dealing with Probate and Guardianship issues with adding personal animosity that can be avoided through mediation.
